Overview

The following terms and conditions shall apply to all services rendered by eSIME.shop, hereafter referred to as eSIME, in connection with the prepaid eSIM reselling. Throughout the site, the terms “we”, “us” and “our” refer to eSIME. By visiting our site and/ or purchasing something from us, you agree that you have read, understood, and agree to be bound by all of these Terms and Conditions Use. If you do not agree to all the terms and conditions, then you may not access the website or use any services.

1. Description of service
   1. eSIM service

      eSIME.shop sells prepaid eSIMs. Customers buy their eSIMs on https://eSIME.shop.

   2. Registration

      The customers must accept the general terms and conditions to use eSIME.
      The customers provide the following information:

   3. Start, Duration and Termination

      The service between eSIME and the customer starts upon order at eSIME website https://eSIME.shop. The duration will be as per the terms of the plan purchased. The service ends either on full consumption of plan or expiry of duration of the plan, whichever is earlier.

   4. Engagements
      1. eSIME’s engagements

         eSIME shall use reasonable steps to make the Service available to you at all times, contingent upon our and/or our service provider’s ability to maintain network capacity and connection availability. However because eSIME relies on technology and networks provided by its partners, eSIME cannot guarantee network coverage, quality or availability of the Service.eSIME partners with other entities to provide the Service. eSIME is under no obligation to inform the customer if it uses services from such partners. Customers agree to comply with Terms and Conditions of our partners as well.

      2. Customers’ engagements

         The Customer must not engage in any action:
         that is abusive, illegal, or fraudulent;
         that causes the Network to be impaired or damaged;
         When the customer is in breach of its obligations eSIME may suspend the customer’s use of the Service, and the customer will continue to be liable and shall pay all charges due under these Terms and Conditions in respect of the suspended Services. Do note that any attempt to deliberately damage or undermine the legitimate operation of the Services and the Program may be in violation of criminal and civil laws. eSIME reserves the right to seek remedies and damages (including attorney fees) to the fullest extent of the law, including criminal prosecution.

2. Payment, Replacement, Cancellation and Refund
   1. Payment

      The payment is made by Shopify Pay and PayPal.

   2. Delivery

      eSIMs will be delivered via email. The customer has to offer a verifiable email address in order to get the QR codes of eSIMs.

   3. Replacement and Cancellation

      Customers may request a replacement or cancellation prior to the activation and installation any time within 180 days upon purchase.

   4. Refund

      Customers may request a refund prior to the activation and installation any time within 180 days upon purchase.

      eSIME’s credits or vouchers cannot be refunded or exchanged for cash.

3. Privacy

   All data provided by customers during the usage of eSIME service will be protected corresponding to the relevant terms of privacy regarding customer data.

   All customer provided data saved by eSIME, will be explicitly used for purposes of contractual fulfillment and to inform the customer about products related to their contractual agreement. In this regard, the customer agrees explicitly, that they approve and agree to the mailing of such information, also for marketing purposes and in electronic form, e.g. via email. Revocation of consent may be served at any time but must be made in writing to eSIME, stating the affected email addresses.

4. Intellectual Property

   All content, trademarks, logos, website designs, audio, video, text, and photographs on our website are the property of eSIME or third-party licensors. You may not use such content without our written permission.

5. Disclaimer

   eSIME is not liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our Services, including but not limited to reliance on any information obtained from eSIME, or that result from mistakes, omissions, interruptions, deletion of files, or emails, errors, defects, viruses, delays in operation or transmission, or any failure of performance.

6. User comments, feedbacks, and submissions

   If, at our request, or without a request, you send specific submissions, including but not limited to texts, photographs, videos, creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'submissions'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any submissions that you forward to us. We are and shall be under no obligation (1) to maintain any submissions in confidence; (2) to pay compensation for any submissions; or (3) to respond to any submissions.

   You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

7. Legal Validity

   These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Wyoming, United States.

8. Changes to Terms

   We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our Services following any changes means you accept and agree to the updated Terms.
